General Terms and Conditions
The course materials that you receive during your enrollment are protected by Federal Copyright law and are meant for your personal use only. The term "course materials" includes all proprietary LLM BAR EXAM materials, as well as any information or data distributed or received in hard copy or by email. By signing this agreement, you agree not to reproduce, redistribute, share, sell, auction, or give away any such materials in any form, either during or after your enrollment. Violation of this agreement is harmful to LLM BAR EXAM and may subject you to civil penalties and/or criminal prosecution.
Your enrollment cannot be shared, resold, auctioned, or transferred to another person in any manner. Enrolled students agree to complete payment of tuition prior to instruction, or as otherwise instructed in writing by LLM BAR EXAM, except as otherwise provided in this document.
3. Cancellations and Refunds
NO REFUNDS WILL BE GRANTED ONCE ANY COURSE MATERIAL HAS BEEN DELIVERED EITHER ELECTRONICALLY OR ON HARD COPY OR/AND CODES TO ACCESS LECTURES HAVE BEEN RELEASED, EXCEPT AS PROVIDED IN PARAGRAPH 4 BELOW.
4. Ineligibility Refund
LLM BAR EXAM will refund your total tuition paid less the Enrollment Fee and a $200 processing and administrative fee if a final decision is issued by the Bar Examiners that you are ineligible to sit for the Bar Examination. If you choose to appeal the Bar Examiners’ decision, you will not be eligible for a refund under this paragraph unless a final decision is issued against you. In order to receive this refund, you must provide official final proof of ineligibility within (3) calendar days of receiving notice of ineligibility from the Bar Examiners; this official final proof can be provided electronically by emailing the full notification from the Bar Examiners to the LLM BAR EXAM Enrollment Department (email@example.com). You must also ship all LLM BAR EXAM materials back to LLM BAR EXAM within (3) calendar days of receiving your notice of ineligibility from the Bar Examiners. You are required to provide shipment information (in the form of a tracking number) as proof that the materials were shipped within this time frame. Both of these requirements must be satisfied in order to receive the ineligibility refund under this paragraph. STUDENTS WHO RECEIVE NOTICE THAT THEIR APPLICATION WILL NOT BE REVIEWED IN TIME FOR THE NEXT BAR EXAMINATION OR THAT THEIR APPLICATION IS INCOMPLETE DO NOT QUALIFY FOR A REFUND UNDER THIS PARAGRAPH. IT IS SOLELY THE STUDENT’S RESPONSIBILITY TO COMPLY WITH ALL FOREIGN ELIGIBILITY DEADLINES AND REQUIREMENTS. No exceptions will be granted.
5. Final Payment and Authorization Charge
In consideration of being provided a tuition credit and access to the Multistate Subjects Lectures student authorizes LLM Bar Exam to charge the credit card provided for the outstanding amount without any further necessary authorization and all previous and future payments to LLM BAR EXAM are nonrefundable except as provided in Paragraph 4. In case of default of student obligation the entire balance shall become due and payable and (v) LLM Bar Exam will immediately submit Student's account for collection. Student hereby agrees to waive any right to contest such actions by LLM Bar Exam in the event of a default.
6. Deposit for Materials
LLM BAR EXAM requires a fully refundable deposit of $250 plus a $30 domestic shipping fee for a set of course materials (international shipping fees are calculated based on shipping destination). The deposit (but not the shipping fee) will be refunded within 8-10 weeks of the deadline for returning the materials if the full set of materials is returned by the deadlines set forth in this paragraph. All materials must be returned to the address provided no later than August 15 (for the July Bar Exam) and March 15 (for the February Bar Exam). If a student fails to return the full set of materials by the applicable deadline, or if the materials are incomplete, the student will forfeit the deposit. All course materials must be returned in one box; multiple or separate shipments of course materials will not be accepted. Students are responsible for ensuring the timely delivery of materials and assume all risks related to the shipment of materials. Update for the February 2017 course: the domestic shipping fees are $40 and the book deposit does not apply. All sales are final.
7. Roll Over
Students can freely roll over their enrollment to the following Bar Examination once they have paid the Enrollment Fee.
8. Money Back Guarantee and Free Repeat Course
To be eligible for the money back guarantee, unless otherwise stated, you must have received your LL.M. degree from an ABA-approved law school and registered to take the next scheduled Bar Examination immediately following your LLM BAR EXAM preparation. You must be enrolled in one of LLM BAR EXAM's July Bar Exam Classroom Sessions. In addition, to maintain this benefit, you must timely turn in all homework assignments, attend all scheduled meetings with your assigned tutor. To be eligible for the refund of your tuition, you must have returned all materials no later than August 15 (for the July Bar Exam), you must send a written demand for a refund to LLM BAR EXAM, 70 West 36th Street, 12th Floor, New York, NY 10018 within fourteen (14) days from the date of the mailing of the official letter with the official results from your state’s Board of Law Examiners. You must, in addition to your request, attach a copy of your Bar Examination Score. In the event your tuition is paid by a third party, any refund will be paid to the third party. Alternatively, LLM BAR EXAM offers each enrolled student unlimited repeat courses with no additional tuition due. Students will be required to pay a nonrefundable $250 book replacement fee and applicable shipping fees to receive a new set of materials if needed. Requests for a free repeat course must be emailed to firstname.lastname@example.org. Upon receipt of the nonrefundable materials deposit and shipping fee, a new set of materials will be shipped to the student. Students who choose to retake the course do not qualify for a refund of his/her tuition. If a student receives a refund of his/her tuition, he/she cannot retake the course without paying additional tuition.
LLM BAR EXAM WILL GUARANTEE A CLASSROOM LOCATION ONLY IF TWENTY (20) OR MORE STUDENTS HAVE COMPLETED ENROLLMENT IN THAT LOCATION AND LLM BAR EXAM HAS SECURED A CLASSROOM AT THAT LOCATION PER THE POLICIES OF THE RESPECTIVE LAW SCHOOL. A STUDENT IS CONSIDERED FULLY ENROLLED WHEN HE/SHE HAS PAID THE FULL TUITION AMOUNT. IF THE NUMBER OF ENROLLED STUDENTS AT A LOCATION IS LESS THEN TWENTY (20) STUDENTS, LLM BAR EXAM RESERVES THE RIGHT NOT TO OFFER THAT LOCATION. LLM BAR EXAM WILL NOTIFY STUDENTS AT LEAST TEN (10) DAYS BEFORE THE BEGINNING OF THE COURSE IF A LOCATION CHANGES OR IS NO LONGER AVAILABLE. IF NO CLASSROOM IS OFFERED IN THE STUDENT’S SELECTED LOCATION, THE STUDENT WILL HAVE THE OPTION TO SWITCH TO ANOTHER LOCATION OR TO THE ONLINE REMOTE COURSE AT NO ADDITIONAL CHARGE.
I agree to the jurisdiction of the Courts of the State of New York.
I acknowledge that I am enrolling with LLM BAR EXAM for the sole purpose of my Bar Examination preparation and not at the direction of, or for the benefit of, a LLM BAR EXAM competitor.
